President John Dramani Mahama has dismissed Chief Justice Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo from office with immediate effect. This action is connection with the violation of Article 146(9) of the 1992 Constitution.
The judgement was made following receipt of a report received from the Committee of Inquiry, which was created under Article 146(6) of the Constitution to look into a petition filed by Mr. Daniel Ofori, a Ghanaian citizen, demanding the Chief Justice’s dismissal.
After a thorough examination of the petition, broad evidence, and testimonies, the Committee settled that the allegations of stated misbehaviour under Article 146(1) had been adequately proven. It is therefore recommended her removal from office.
The President is therefore required to follow the Committee’s conclusions and recommendations in accordance with Article 146(9) of the Constitution.
According to a statement released on Monday, September 1, 2025 by the Minister for Government Communications and the Spokesperson to the President, Felix Kwakye Ofosu, the Chief Justice’s dismissal was legal
Both the petitioner and the Chief Justice were given a full opportunity to submit their cases before the Committee, he told the public, and the procedure was carried out strictly in accordance with constitutional standards.
