Attorney-General and Minister for Justice, Dr. Dominic Ayine, says Ghana cannot formally request the extradition of former Finance Minister Ken Ofori-Atta from the United States until a complete legal case is built.
Speaking at the Government Accountability Series in Accra on Wednesday, October 22, 2025, Dr. Ayine explained that international extradition requires a fully developed docket and filed charges before any request can be made to U.S. authorities.
“You cannot make a request unless you have a solid case, a docket that has been built,” he stated.
His comments follow revelations by Deputy Attorney-General Dr. Justice Srem Sai that the Office of the Special Prosecutor (OSP) has yet to release the case docket, despite repeated formal requests. The OSP attributes the delay to ongoing evidence compilation from a June 10 search and seizure at Strategic Mobilisation Ghana Limited (SML).
Dr. Ayine emphasized that Ghana must follow due process, citing the U.S. Justice Department’s six-year investigation into Kwadwo Boateng before his extradition. He noted that the U.S. provided a Bill of Indictment, including charges and supporting facts.
“Without a docket, we cannot make the request. So we are still waiting,” he added.
